1. About these terms

These Terms of Service govern access to and use of the Start Webcast Pty Ltd website, online services, connected integrations and any related user-facing features (together, the Services). By accessing or using the Services, you agree to these terms. If you use the Services for an organisation, you confirm that you have authority to bind that organisation.

2. Eligibility and accounts

You must be legally capable of entering a binding agreement and provide accurate, current information. You are responsible for protecting your login credentials, for activity under your account and for promptly notifying us of suspected unauthorised use.

3. Acceptable use

You must use the Services lawfully and must not:

  • infringe another person's rights, confidentiality, privacy or intellectual property;
  • upload or process unlawful, harmful, deceptive or malicious content;
  • interfere with security, availability or operation of the Services;
  • attempt unauthorised access, scraping, reverse engineering or circumvention of technical limits, except where the law permits it; or
  • use the Services to send spam, distribute malware or facilitate unlawful conduct.

4. Connected services and user instructions

You may choose to connect third-party services, including Google services. You authorise us to access and process connected data only to provide features you request and within the permissions you grant. Certain consequential actions, including creating Gmail drafts or moving mail to Junk, require your explicit approval. Third-party services remain subject to their own terms and availability.

5. Your content

You retain ownership of content and data you submit or connect. You grant Start Webcast Pty Ltd a limited, non-exclusive licence to host, copy, transmit and process that content only as reasonably necessary to operate, secure and provide the Services you request. You confirm that you have all rights and permissions required to provide that content.

6. Our intellectual property

The Services, website content, branding, software and materials supplied by us are owned by or licensed to Start Webcast Pty Ltd. Except as expressly permitted, you may not reproduce, modify, distribute or commercially exploit them without prior written consent.

7. Service availability and changes

We may maintain, update, change or discontinue parts of the Services. We aim to provide reliable Services but do not promise uninterrupted, error-free or completely secure operation. We may suspend access where reasonably necessary for security, maintenance, legal compliance or suspected breach of these terms.

8. Fees and commercial engagements

Any quoted production, engineering, equipment hire, subscription or professional service fees are governed by the applicable proposal, order form or separate agreement. If there is an inconsistency, that specific written agreement prevails for the relevant engagement.

9. Consumer guarantees

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Where the Australian Consumer Law permits us to limit liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to supplying the relevant services again or paying the cost of having them supplied again.

10. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as available” basis. Outputs from automated or artificial-intelligence-assisted features may be incomplete or inaccurate and should be independently checked before important decisions. You remain responsible for reviewing and approving actions taken through the Services.

11. Liability

To the maximum extent permitted by law, Start Webcast Pty Ltd is not liable for indirect, incidental, special or consequential loss, loss of profit, revenue, opportunity, goodwill or data arising from use of the Services. Any liability that cannot be excluded will be reduced to the extent that your act or omission contributed to the loss. This clause does not limit liability where doing so would be unlawful.

12. Indemnity

To the extent permitted by law, you indemnify Start Webcast Pty Ltd against third-party claims, losses and reasonable costs arising from your unlawful use of the Services, your content, or your material breach of these terms, except to the extent caused by our negligence, unlawful conduct or breach.

13. Termination

You may stop using the Services at any time. We may suspend or terminate access for a material breach, security risk, unlawful use or where required by law. Provisions intended by their nature to survive termination, including intellectual property, liability and dispute provisions, continue to apply.

14. Privacy

Our Privacy Policy explains how we handle personal information, including information accessed through connected Google services.

15. Changes to these terms

We may update these terms from time to time. We will publish the revised terms and update the effective date. Where a change materially affects your rights, we will take reasonable steps to provide notice.

16. Governing law

These terms are governed by the laws of New South Wales, Australia. Subject to any non-excludable rights, the parties submit to the courts of New South Wales and courts entitled to hear appeals from them.
